Terms of Service | Flying Video

Terms for Flying Video accounts, AI video generation, subscriptions, credits, and refunds. Operated by Springtide Labs LLC.

Last updated: 2026-10-19

Version 1.1. Effective date: 19 October 2026.

1. Who we are and acceptance

Flying Video at flyingvideo.net is operated by Springtide Labs LLC, a Delaware limited liability company, at 131 Continental Dr, Suite 305, Newark, DE 19713, United States ("we", "us"). Contact: support@flyingvideo.net.

By creating an account, purchasing, or using the service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service. Mandatory consumer rights are not affected.

2. The service and digital delivery

We provide AI-assisted video generation from uploaded photos, scene notes, and templates, together with independent video research. Models and quality tiers differ: some generate a finished video directly; others provide a draft with an optional paid upgrade. Review the selected model, credit cost, resolution, duration, and audio availability before generating.

This is a digital service; nothing is shipped. After confirmed payment, credits are added to the signed-in account. Videos become available to preview and download in My videos after processing. Generation time varies and is not guaranteed. APIMart and its underlying AI model providers supply moderation and generation; Cloudflare supplies hosting and storage. We are responsible for supporting Flying Video.

Flying Video is independent of Tesla, SpaceX, and the AI model providers. Their names and marks belong to their respective owners. Research, examples, and generated effects are not official announcements or evidence of a real event.

3. Eligibility and accounts

You must be at least 18, or the age of majority where you live if higher, and able to enter into a binding agreement. Provide accurate account and billing information, keep your credentials secure, and report unauthorized access to support@flyingvideo.net. Do not share or resell accounts to bypass limits. You are responsible for activity you authorize under your account.

4. Prices and payment providers

Current plans, prices, currency, credit amounts, and product limits are on the Pricing page and are shown before checkout. Prices are in US dollars unless checkout states otherwise. Applicable tax and any currency conversion are shown before payment. Confirm the total before purchasing.

For purchases completed through Waffo Pancake, Waffo acts as merchant of record and authorized reseller, handling payment, transaction tax, receipts, refunds, and disputes under its Buyer Terms. For purchases completed through Stripe Managed Payments, the merchant of record is Sold through Link, LLC, a Stripe affiliate, under Link's terms. The provider and seller on your checkout and receipt determine which purchase terms apply; available payment methods may vary. These Terms govern the Flying Video service in either case. We do not store full card numbers or card security codes.

5. Subscriptions and authorization

If you choose a monthly subscription when one is offered, it is billed in advance and renews automatically each month until canceled. By purchasing a subscription, you authorize the checkout provider to charge your selected payment method at the price and interval displayed at checkout, including applicable taxes. There is no free trial unless expressly offered before checkout. A failed renewal does not grant a new allocation of credits.

Cancel online at Settings → Billing using the subscription's cancel action before the next renewal. Cancellation stops future renewal charges and takes effect at the end of the paid period. It does not automatically refund the current period or delete your account. If the action fails or is unavailable for your provider, contact us for assistance. We will give advance notice of material recurring-price changes; you can cancel before they take effect.

6. Credits and one-time purchases

  • Monthly plans, when offered, issue credits after each successful payment. Each allocation expires at the end of its paid billing period, as shown in your account. Unused monthly credits do not roll over into the next period.
  • One-time credit packs are charged once and are valid for 365 days from issuance. They do not renew, and we do not automatically top up your balance.
  • Canceling a subscription does not extend or shorten the original expiry of credits already issued, including separately purchased packs. Refunded credits are removed.
  • Purchased credits with the earliest expiry are consumed first, regardless of whether they came from a subscription or a pack. The generation flow shows the cost before you submit; a draft and its optional upgrade are separate charges.
  • Credits are for Flying Video only. They cannot be transferred, resold, or exchanged for cash except through an eligible refund. Promotional credits have no refundable purchase value.

7. Failures and refunds

When a generation or upgrade is marked failed or blocked without delivering its result, its charged credits are restored to your balance. The original credit expiry still applies; if it passed while the task was processing, contact support. This restores credits; it is not a cash refund. If a task remains pending or the balance appears wrong, contact support with the task ID.

Within 14 days of a credit-pack purchase or a subscription payment, you may request a refund for that payment's unused purchased credits. A completely unused allocation qualifies for a full refund; a partly used allocation qualifies for the unused proportion. Used credits and successfully delivered videos are not refundable solely because you dislike the creative result. Defective or undelivered services and mandatory legal rights are handled separately. See the Refund Policy for the request process, exceptions, and provider rules. Canceling future renewal and requesting a refund are separate actions.

8. Billing questions and disputes

If you do not recognize a charge, think you were charged twice, or did not receive credits, contact support@flyingvideo.net with the order or receipt ID. You may also use the payment provider's support channel on the receipt. Your right to contact your bank or exercise statutory dispute rights is unaffected. We may suspend disputed or unpaid entitlements while a payment issue is resolved. Do not manipulate callbacks, refunds, or chargebacks to obtain duplicate credits.

9. Your inputs and generated output

You keep the rights you hold in uploaded media and scene notes. You must have the necessary copyright, trademark, privacy, and likeness permissions, including valid consent from identifiable people. You grant us a non-exclusive license to store, process, and transmit your content only to provide, secure, and support the service, including sending it to the providers described in our Privacy Policy.

As between you and us, you retain your rights to the output and we assign any rights we may hold in your generated videos to you, to the extent permitted by law and applicable third-party terms. You may download, share, and use output commercially only when you have all necessary rights and comply with those terms. We do not promise copyright protection, exclusivity, or non-infringement; similar results may be generated for others. We do not use your inputs or outputs to train our own AI models. Third-party processing is described in the Privacy Policy.

10. Acceptable use and reporting

Our Acceptable Use Policy forms part of these Terms. It separately prohibits sexual/NSFW content; violence and gore; hate speech; child sexual abuse material (CSAM), with zero tolerance; deepfakes and impersonation; and copyright or trademark infringement. It explains the actual prompt and provider checks, reporting targets, enforcement, and appeals. Do not bypass safety checks or access controls, access another user's files, scrape disruptively, overload the service, or resell access.

Report suspected violations to support@flyingvideo.net with the relevant URL or task ID and a description. Do not attach illegal material. We aim to acknowledge content reports within 2 business days and provide an initial assessment or progress update within 5 business days, prioritizing urgent child-safety and credible-threat reports when we become aware of them. Complex reports may take longer. We may remove content we control, reject requests, restrict generation, or suspend or terminate service access for violations. We may revoke fraudulent or abusive credits and promotional credits; account action does not automatically forfeit legitimately purchased unused credits or mandatory refund rights. Appeals use the same email channel.

11. Privacy, storage, and security

Our Privacy Policy explains account, media, payment, and usage data. Source images and generated videos can be stored on Cloudflare R2 and APIMart's CDN. Media URLs are unlisted, not access-controlled private links: anyone who obtains a URL may be able to open it. Do not upload confidential or sensitive material that requires private storage. We currently have no automatic media-deletion schedule; contact support to request deletion and download files you want to keep. We do not guarantee permanent storage.

12. Disclaimers and liability

AI output can contain visual errors, distort identities, or fail to follow instructions. Check every result before use. To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of uninterrupted availability, fitness for a particular purpose, or accuracy.

To that extent, Springtide Labs LLC is not liable for indirect or consequential losses, loss of profits, or loss of data. Our total liability relating to the service is limited to the greater of the amount you paid for Flying Video in the 12 months before the claim or US$100. These limits do not exclude liability that cannot lawfully be excluded or reduce mandatory consumer remedies.

13. Suspension and closing your account

You may stop using the service at any time. Cancel active subscriptions online before requesting account deletion at support@flyingvideo.net from your account email. Deletion requests are handled manually; there is no automatic account-deletion button. We may restrict access for abuse, security risks, or nonpayment, subject to applicable law and refund rights. Rights and obligations that by their nature survive termination continue to apply.

14. Governing law

These Terms are governed by Delaware law, excluding conflict-of-law rules. Disputes may be brought in the state or federal courts in Delaware, except where mandatory law entitles you to local courts or different protections. Contact support first if you would like us to help resolve a concern.

15. Changes and general provisions

We will update the version and date when these Terms change. We will notify existing users of material changes at least 14 days before they take effect through the website or account email, except where a legal or urgent security requirement needs earlier action. Previously confirmed purchases retain the terms applicable when purchased unless the law requires otherwise. If a provision is unenforceable, the rest remains effective.
